Aircraft engines warranty conditions

WALTER ENGINES a.s.
Validity: Since May 1, 2005
1. DEFINITIONS
1.1. „WALTER“ means WALTER ENGINES a.s. having its business in Prague, Czech Republic.
1.2. „Engine“ means the M601 turboprop engine.
1.3. „Owner“ means legal owner of the Engine which is subject to the Warranty. The Warranty is transferable to subsequent owner after prior written notification to WALTER.
1.4. „Flight Hours“ means the total number of flight hours since the engine was delivered by WALTER (new, overhauled or repaired).
1.5. „Flight Cycles“ means the total number of flight cycles since the engine was delivered by WALTER (new, overhauled or repaired) calculated in accordance with the formula provided by WALTER for the type of operation applicable for the respective Engine.
1.6. „Part“ means parts of the Engine which are delivered with the Engine and included in the price of the Engine.
1.7. „Malfunction“, „Failure“ or „Defect“ means improper function or breakage determined to WALTER’s satisfaction to be due to causes within WALTER’s control.
1.8. „Warranty Period“ is the term specified in Flight Hours, Flight Cycles and Calendar Time in the respective Contract for delivery, overhaul or repair of the Engine.
1.9. „Performance Claim Form“ means form provided by WALTER which contains information necessary for initiation of warranty claim.
1.10. “TBO” means time between overhauls and represents the number of Flight Hours, Flight Cycles and calendar years between scheduled overhauls.
2. WHAT IS COVERED
2.1. Subject to limitations hereinafter WALTER warrants the Engine at the time of delivery to be free from Defects in material or workmanship and will conform to the applicable specification.
2.2. WALTER will, at its option, correct, repair or replace the Engine or its Part which in the sole discretion of WALTER is found to be defective within the Warranty Period. The replacement Parts may be new Parts or Parts with the service life sufficient till the next scheduled overhaul of the Engine. The replaced Engine or Part shall become the property of WALTER.
2.3. WALTER will, at its option either arrange the installation of the Engine or Part or pay reasonable labor installation costs. The amount of such costs should be agreed and approved by WALTER in advance in order to be accepted by WALTER within the terms of this warranty. As guideline for such cost calculation the labour hours allowed by WALTER for the same or similar type of work shall be used (examples are set forth below in Art. 8 Warranty labour allowance).
3. WHAT IS NOT COVERED
3.1. Cost of scheduled maintenance and overhaul and any other costs related to Engine maintenance, repair and overhaul not specifically covered under this Warranty.
3.2. Normal wear and tear and deterioration. Engine or Part which is capable of continued operation without corrective action is considered as being normal.
3.3. The Warranty shall not apply provided the Defect, Failure or Malfunction of Engine or Part is caused by factors beyond control of WALTER. Such factors are:
· any storage, installation, operation, usage or maintenance which is not in accordance with WALTER manuals, airworthiness directives, bulletins, instructions and recommendations;
· any alternation, modification or repair performed by anyone other than WALTER or its authorised representatives;
· accidents, misuse, neglect, negligence, fire, lightning strike after delivery by WALTER;
· ingestion of foreign objects, dirt inside or outside of Engine or Part, corrosion, erosion, sulphidation or any other damage due to the operating environment;
· use of Part with expired TBO, use of Engine or Part from which the part number or serial number has been removed or modified;
· use of Part delivered by other company than WALTER;
· any other factor beyond WALTER control.
4. RESPONSIBILITY OF WALTER
4.1. WALTER shall within 15 days from the delivery of completely filled Performance Claim Form resolve the warranty claim or inform Owner about the proposed warranty claim solution. The applicable place in WALTER for all warranty claims is the Product Support Department.
4.2. WALTER shall repair or replace Parts which are damaged as resultant damage in connection with the Failure of Part which is covered by this Warranty. Repair or exchange of any other Part which is not covered by the Warranty and is required by WALTER Quality Assurance Department shall be performed at the Owner´s costs.
4.3. In the case of significant damage of the Engine WALTER may decide to perform the complete overhaul of the Engine to the full TBO status. In such case the Owner shall pay WALTER the proportion of the average overhaul cost for the portion of the TBO used on the Engine prior to the Warranty Claim.
5. RESPONSIBILITY OF OWNER
5.1. Owner is responsible for storage, installation, use, operation and maintenance of Engine in accordance with WALTER manuals, airworthiness directives, bulletins, instructions and recommendations.
5.2. Owner shall keep adequate records of engine operation and maintenance. These records should be sent to WALTER by e-mail or fax at least two times each year (in June and December) during the whole Warranty Period. Failure to do so shall automatically terminate the Warranty Period.
5.3. Owner shall notify WALTER in written form about any warrantable Defect Malfunction or Failure within 15 days of its discovery.
5.4. The defective parts shall be returned by Owner to the supplier who furnished the replacement parts within 30 days after the replacement parts are delivered. In the case that this condition is not fulfilled the Owner is obliged to pay full price of the replacement parts to the supplier.
5.5. For warranty repairs the Engine shall be delivered to the facility designated by WALTER Product Support Department in accordance with WALTER’s written instructions. Owner shall bear the transportation cost of Engine or Parts to and from such designated facility.
5.6. In the case of change of ownership of the Engine WALTER should be notified in written form about this fact no later then 60 days after such event happens. Failure to do so shall automatically terminate the Warranty Period.
6. ADDITIONAL COVERAGE POLICY
6.1. If after the expiration of the Warranty Period extensive damage of the Engine which requires premature overhaul occur as result of engine chargeable event WALTER may at is sole discretion decide to decrease the price of such overhaul.
6.2. The price of such overhaul may be reduced by the portion of average overhaul costs which is adequate to the portion of the Flight Hours or Flight Cycles till the scheduled IRAN Overhaul which can not be used by the Owner due to the premature overhaul requirement.
6.3. The extend of the price reduction depends on the sole decision of WALTER.
7. LIMITATIONS
7.1. This Warranty is the only warranty applicable to the M601 Engines and is given and accepted in place of all other warranties or remedies, whether express or implied or statutory, such as warranties of merchantability or fitness for particular purpose.
7.2. The correction of Malfunction or Failure shall in no way extend the Warranty Period.
7.3. In no event shall WALTER be responsible for incidental or consequential damages or for expenses incurred external to the Engine as a result of an Engine or Part defect.
7.4. No variation or extension of this Warranty shall be binding for WALTER unless in writing and signed by a duly authorised representative of WALTER.
7.5. Owners acceptance of this Warranty or the making of any claim or receipt of any benefit thereunder constitutes Owner´s acceptance of all the foregoing terms conditions and limitations.
8. WARRANTY LABOUR ALLOWANCE
8.1. Removal and installation labour at competitive rates but in no case rates higher then charged by WALTER will be allowed for removal and installation time not exceeding the time listed below. Any other part or component which is not listed below the allowed time shall not exceed one (1) hour unless specifically agreed and approved by WALTER in written form prior to such work is performed.
